1. Who We Are

W. Park Title Agency, LLC and W. Park National Title Agency LLC, together with their affiliates (collectively, “W. Park,” “we,” “us,” or “our”), provide title insurance, escrow and settlement services, and related real estate transaction services in New York, Florida, and nationally through arrangements with licensed underwriters. Our website is available at www.wparktitle.com (the “Site”).

We are a financial institution under the federal Gramm-Leach-Bliley Act (“GLBA”). We are subject to the New York Department of Financial Services Cybersecurity Regulation at 23 NYCRR Part 500 and to state privacy and data-security laws in the jurisdictions where we operate, including the New York SHIELD Act and the Florida Information Protection Act.

This Privacy Policy explains what information we collect, how we use it, when and with whom we share it, how we protect it, and the rights you have.

2. Scope

This Privacy Policy applies to information we collect through the Site and through the forms, email addresses, and phone numbers listed on the Site. It does not apply to information collected by our underwriters, service providers, or other third parties on their own sites or platforms, each of which has its own privacy policy. Links to third-party sites are provided for convenience only.

3. Information We Collect

3.1 Information you provide to us

When you use the Site or contact us, you may provide:

  • Contact information such as your name, email address, and phone number.
  • Order information submitted through our online order form, which may include property address, transaction type, purchase price, loan amount, parties to the transaction, counsel, lender, and other deal details.
  • Messages and attachments you send to us.
  • Preferences you tell us about, such as how you prefer to be contacted.

3.2 Information we collect automatically

When you visit the Site, our hosting platform and any analytics or security tools we use may collect:

  • IP address, browser type, operating system, device identifiers, referring URL, pages viewed, and approximate location derived from IP.
  • Dates and times of visits and actions taken on the Site.
  • Cookies and similar technologies placed on your device for essential site functions (such as form submission, load balancing, and security).

The Site does not currently run third-party advertising or marketing cookies. If we add analytics or marketing tools in the future, we will update this Policy and, where required, present a cookie banner.

3.3 Information from third parties

In the ordinary course of a title or settlement transaction, we receive information from third parties such as lenders, real estate agents, attorneys, buyers, sellers, title examiners, municipal recording offices, credit bureaus, courts, and underwriters. That information can include names, addresses, dates of birth, Social Security numbers, account numbers, loan terms, tax and lien information, and documents relating to the real property.

3.4 Sensitive information

Some information we handle, such as Social Security numbers and financial account numbers, is sensitive. We collect and use this information only for the specific purpose for which it was provided (typically, closing a real estate transaction and issuing title insurance) and we apply the safeguards described in Section 6.

4. How We Use Information

We use the information we collect to:

  • Respond to inquiries and provide customer service.
  • Open and service a file, including preparing title commitments, closing statements, disbursement instructions, recording packages, and final policies.
  • Verify identity and comply with anti-fraud, anti-money-laundering, and wire-fraud-prevention requirements.
  • Communicate with you and with other parties authorized to be part of the transaction.
  • Send you transactional emails and, with your consent, SMS messages as described on our contact page.
  • Maintain records required by law, by our underwriters, or by sound business practice.
  • Detect, investigate, and prevent fraud, security incidents, and other unlawful activity.
  • Comply with legal obligations and respond to lawful requests from regulators, courts, and law enforcement.

5. How and When We Share Information

We share information only as described in this Policy. We do not sell your personal information, and we do not share it for third-party marketing purposes.

5.1 Service providers

We share information with vendors who perform services for us, such as title production software, document storage, email hosting, e-signature, escrow wire verification, and secure payment portals. These vendors are contractually obligated to use the information only for the services they provide to us and to protect it with reasonable safeguards.

5.2 Parties to the transaction

To close a real estate transaction, we share information as reasonably necessary with the lender, the other side’s counsel, the real estate brokers, the escrow agent, the underwriter, municipal or county recording offices, taxing authorities, and other participants required to move the deal forward.

5.3 Underwriters

We share information with title insurance underwriters, which may include First American Title Insurance Company, Stewart Title Guaranty Company, Old Republic National Title Insurance Company, and others, as needed to issue a title commitment or policy and to administer claims.

5.4 Legal and regulatory

We may share information when we believe in good faith that disclosure is required by subpoena, court order, regulatory demand, or applicable law, or is necessary to protect our rights, the safety of any person, or the integrity of the Site.

5.5 Business transitions

If W. Park undergoes a merger, acquisition, restructuring, financing, or sale of all or part of its assets, information may be transferred as part of that transaction, subject to protections at least as strong as those in this Policy.

5.6 With your direction

We will share information with anyone else you direct us to share it with, including in writing during a transaction.

6. How We Protect Information

We maintain an information security program designed to meet the standards of 23 NYCRR Part 500, the NY SHIELD Act, and the Florida Information Protection Act. Our safeguards include:

  • Access controls and least-privilege permissions for employees and contractors.
  • Encryption of sensitive information in transit and, where practical, at rest.
  • Multi-factor authentication on email and production systems.
  • Ongoing staff training on phishing, wire fraud, and data handling.
  • Written incident response procedures and a designated individual responsible for our cybersecurity program.
  • Vendor due-diligence procedures for service providers with access to non-public information.

No system is perfectly secure. If you believe your interaction with us has been compromised, contact us immediately at the address in Section 12.

7. Breach Notification

If we experience a security event that triggers notification obligations under the NY SHIELD Act, the Florida Information Protection Act, the NY DFS Cybersecurity Regulation, or any other applicable law, we will notify affected individuals and regulators in the manner and within the timeframes required by law.

8. Retention

We retain information only as long as needed for the purposes described in Section 4 or as required by law, our underwriters’ guidelines, or legal-hold obligations. Closed-file and escrow records are retained for the periods required by New York and Florida insurance and real estate recordkeeping rules, after which they are securely destroyed.

9. Your Rights

Depending on where you live, you may have rights to:

  • Request confirmation of whether we process information about you.
  • Request access to or a copy of that information.
  • Request correction of inaccurate information.
  • Request deletion, subject to legal, regulatory, and legitimate-business exceptions (for example, we cannot delete closing records we are required to retain).
  • Opt out of certain communications.
  • Submit a complaint to us or to your state regulator.

To exercise any of these rights, contact us using the information in Section 12. We will respond within the timeframes required by applicable law. We will not discriminate against you for exercising a privacy right.

10. California Residents (CCPA / CPRA)

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act:

  • Right to know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it.
  • Right to delete personal information, subject to the exceptions in the statute.
  • Right to correct inaccurate personal information.
  • Right to limit use and disclosure of sensitive personal information to the purposes permitted by the statute.
  • Right to opt out of “sale” or “sharing” of personal information. We do not sell or share personal information as those terms are defined by the CCPA.
  • Right to non-discrimination for exercising any CCPA right.

Much of the personal information we handle in a title or settlement transaction is exempt from the CCPA because it is regulated under GLBA. Categories of personal information we collect are described in Section 3. Sources and purposes are described in Sections 3, 4, and 5.

To submit a CCPA request, email info@wparktitle.com with “CCPA Request” in the subject line, or call the phone numbers in Section 12. We may need to verify your identity before we can act on a request. You may authorize an agent to submit a request on your behalf.

11. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will delete it.

13. Changes to This Policy

We may update this Policy from time to time. The “Effective date” at the top indicates when the current version took effect. Material changes will be posted on this page, and we will take additional steps to notify you when required by law.
